Maybe the basic common sense legal test should be...if you're a potential Darwin Award winner or "near-miss" honorable mention (major stupidity, but didn't quite remove yourself from the gene pool)...it's "case dismissed!" Sounds like a good nominee for a Darwin Award "honorable mention" http://www.darwinawards.com/stupid/.
